Special Immigrant Juvenile Status (“SIJS”) is a type of protection that U.S. law offers to young people who are the most vulnerable of immigrants to the United States. If a child (under 18) has been abused, abandoned, or neglected by one or both of his or her parents in her country of origin, he or she may qualify for SIJS. This type of relief can be somewhat complicated to acquire because it involves working with usually two different courts: the local state probate court near where the child lives, and the Immigration Court. For SIJS, a probate court has to determine that the child requires probate court assistance based on their needs, and that it would not be in the child’s best interests for him or her to be returned to the home country. If a probate court judge agrees to find that these things are true, then the child may apply to the U.S. government for legal status in the United States.
